    No she wouldn't. When the child is adopted, those doing the adopting become the legal parent(s).

    I am hoping that Rishi returns as his brother.

    I still do not understand this, the adoptive parents become the legal parents when the birth parents sign away their rights, and the adoption procedure is completed. In this case surely Georgia would not have signed away her rights and was married to Rishi so surely she would have retained her rights and would still be a legal parent. Surely the social workers handling the adoption would have taken the necessary steps to ensure Rishi and Georgia were both legal parents. This a situation that must arise frequently when marriages/relationships break down and a new partner wants to adopt the children of the remaining birth parent..

    You are correct, and according to the adoption act a child cannot be adopted until at least 6 weeks old, and the biological mother only loses her rights if the child is deemed to be in danger if left with her, also,If an adoption order is made, the applicant will become the legal parent of the child (along with their partner). The legal relationship between the child and the other birth parent will be broken. This is a permanent decision and cannot be reversed at a later date.

    When I married my wife, she had a 3 year old son. When it came to adoption, we both had to adopt him for the reasons I have stated. Your BIB is correct.
