OK, so here's my latest thoughts on the matter.....
Max was sent down. Ian and Jane lied, along with half the Square, who all knew the truth about who killed Lucy. In spite of knowing the truth, they allow Max go to prison for what could have been a very long time. As it was he was in prison for a year.
When the truth about Ian and Jane comes out, the police do nothing about it, with the ridiculous cop out line that "the Beales have already suffered enough." Plus one of the police involved actively connived in getting Max sent down and keeping him there, even though he was told the truth.
No justice and no-one to turn to for Max. So he seeks his own revenge. Normally you would tell people not to take the law into your own hands but to rely on the police and the good old British justice system, but as we've already seen that didn't work and Max had nowhere to turn and, as he saw it, no alternative but to take the law into his own hands.
Now this is a big problem for the Eastenders producers as many people sympathise with Max and want something done to make Ian and Jane face justice. But Eastenders don't want to lose Ian and Jane, certainly not Ian, who has been there since day one. So they make Max into a villain who is not only out for revenge by various nefarious means on the Beales but everybody else it seems, though most of those also knew that Max was innocent. But even making Max into a bigger villain than Gavin doesn't stop people having some sympathy with him still and wanting to see him succeed. So, for EE, one last throw of the dice thought up in one of their weekly conferences. They bring back a real villain who absolutely nobody likes and everyone has utter contempt for - James Wilmott-Brown - to be part of Max's revenge plan in an attempt to finish off sympathy for Max once and for all so the Beales can live happily ever after, while Max is seen as the baddie after all. So, by the greatest of coincidences, Max just happens to share a cell with Willmott-Brown's son, Luke. And the scene is set for the return of a character 25 years after his last appearance, who would, under normal circumstances, have never been revived.

That's what I wondered. After all the things she had said about Arther. Tho it also crossed my mind, that they might have been due to restraining him in hospital maybe.
