If she was speculating , she should have speculated about 5 years which is the maximum sentence for gbh without intent, which is what I assume that Dan was charged with. Given that Lloyd has died, I think you would receive the maximum.

Not necessarily manslaughter, only if the consequences could have been reasonably forseeable. In Dan's case it was bad luck that Lloyd hit his head on the rock instead of the grass.

If you assault someone and they die, it has to be at least manslaughter.

I was annoyed by the judge. He totally failed to take account of the fact that Dan was desperate.
