A three-year-old boy lit a cigarette butt and smoked it in front of his mother, Merthyr Crown Court has heard.

The incident was filmed on a mobile and passed to social services by a friend of the boy's mother Kelly Marie Pocock.

The friend earlier spotted him smoking a cigarette and said it looked like he had been "smoking for many years".

The judge said it was an appalling case and Pocock, 24, from Merthyr Vale, was sentenced to 40 weeks suspended for two years after admitting child cruelty.

But Judge John Curran said he did not jail Pocock because of her "considerable efforts" since the incident.

Prosecutor Jonathan Rees told the court Pocock's friend Natasha Dudley filmed the events after visiting her home just after Christmas 2007.

Mr Rees said Ms Dudley had gone looking for the boy after he had been missing for 30 minutes.

It is clear that the boy, at the age of three, knows what to do with a lighter and cigarette

"She found him underneath the bed with some cigarettes," said Mr Rees.

"He was actually smoking one at the time and Ms Dudley said it looked like he had been smoking for many years."

The court heard that when the boy was taken downstairs he went into the living room where he picked up a cigarette butt from an ashtray and smoked it.

Mr Rees said at this point, Pocock was having a telephone conversation so Ms Dudley decided to film the boy, such was her concern.

"The video demonstrates the boy placing a cigarette into his mouth, lighting it with a lighter and sucking, drawing smoke clearly into the lungs and he seems to do it with some accomplishment," said Mr Rees.

"It doesn't cause him any discomfort. He is sat on a chair close to the mother, who is talking on the phone.

"It is clear that the boy, at the age of three, knows what to do with a lighter and cigarette."

The video was forwarded to social services who then referred the matter to the police.

In interview, Pocock told officers that she did not appreciate the fact that her son was smoking as she was on the telephone.

She also told officers that she was "shocked" when the matter was drawn to her attention.

After being charged, Pocock entered a guilty plea on the basis that she had not seen her son smoking before and had not been told of the incident underneath the bed by Ms Dudley.

I don't see how, despite your basis of plea, you could have been unaware of the fact

Claire Wilks, defending, asked Judge Curran to bear in mind the early guilty plea by her client.

"Fortunately time has now passed and in that time the defendant has been able to prove herself both to her children and, perhaps more importantly, their social worker," said Ms Wilks.

The court heard she had attended six parenting courses since the incident.

Judge Curran said the case was one of the most "extraordinary" he had ever come across.

The judge said the boy would not have been able to smoke without discomfort "unless he had acquired a habit".

"This is an appalling situation and I don't see how, despite your basis of plea, you could have been unaware of the fact," said Judge Curran.

The judge added that while the offence would normally cross the custody threshold, he did not want to cause her children any further emotional harm by separating them from their mother.

Apart from the suspended sentence, Judge Curran imposed a 12 month supervision requirement.

This is awful, but then considering my friends daughter drinks alcohol and red bull at 4, i really aint suprised what parents actually let their children do

sadly a lot of parents wont care. or they let their kids drink alcohol and smoke cos they think it makes their kids look cool and grown up!

im pretty certain thats right, it used to be anyway which i was surprised about. although obviously youre not meant to let your kid get drunk!

Yeah I remember something like that, its not like loads just a tiny bit and I dont think theyd be reallly really drunk
I cant remember one drink my mum once but in my brother milk once to help him to sleep it was only a tsmall amount

erm i dunno really, i dont know anyone in my family who allows their kids to drink at that age

Mum let my brother try beer when he was i dunno 6-9 months old, but it was a dribble, that i do not object to, its people out there who let their kids drink whole bottles of alcohol like my friend does with her child, surely its having bad effects on the child, and she is either to stupid to see it, or just dont care

My Nan used to give my Dad a little bit of guiness or somethign when he was really ill with something or other as a little one...

I've actually seen a 5/6 year old walking around wth a fag in his mouth around my Mums area, and also whilst in Asda with my Mum saw another Mum form my brothers school buying WKD's for her little girl because when they ahve friends around to drink... they let her have a bottle with them. That's jsut downright wrong in my opinion.... but legal, which is stupidly pathetic I think.

It's a load of bull if the mother is saying she did not know her child smoked, how does she think he learned it from. Most of my friends smoke and there kids used to play in the house pretending a pen was a cigarette, so if this three year old can use a lighter someone must have shown him.

As for kids drinking my niece works in the local LIDL shop and one morning an 8 year old boy was caught shoplifting a bottle of vodka at eight thirty in the morning, three of his school friends were waiting outside the shop.

I actually heard on my local radio station in a news article that it is indeed legal for a 5 year old to drink alcohol under the parent's supervision. Surely that is wrong? Am I the only one to think so? The news article was on about that teenagers should no longer be able to be allowed to drink. So you can drink from 5 until 13 years of age, then you have to go on the waggon for 5 years until you are adult enough to decide what kind of drink you want.

It is legal for a child aged five to consume alcohol in the presence of either parent in the home. You'd have to be highly irresponsibly to allow it though.

If you're aged 14 and above you can sit in a pub and have a meal and one alcoholic drink if accompanied by an adult. However, every pub I have been in doesn't allow under 18s to drink alcohol under any circumstances.

My mum used to put a drop of rum in my bedtime bottle to help me sleep. Never did me any harm, can't stand rum now. My nanna did the same when my mum was a child.

If you went on a school trip then you definitely wouldn't have been allowed to drink. It would be irresponsible and illegal for teachers to let under age children consume alcohol/

yeh my teachers wouldnt let us drink even if we were in a country where it was legal

That's the law as it stands. I heard on the news the other day that they recommend that alcohol is not given to children under the age of 15 but that it will not be made law. I think it's silly, clearly if 3 year olds are smoking parents don't always listen to the law so why would they listen to recommendations? :rolleyes:
