Was just wondering if anyone could help me out.

Ive been suffering from flu/cold for the passed week or so. I have been going to work as normal as work comes down really hard on people when ill at xmas time.

On sunday it came to a head and i lost my voice, i went into work yesterday and explained that there was no way i could go on the phones (work in a call centre for those who dont know) but i would be willing to do rekeying or floorwalking, I was told i either go one the phones or go home, i had no choice but to go home.

Even though they are offering massive amounts of overtime for rekeying there still wasnt an option for me to be in work off the phones, and when two girls in my team lost their voice 2 weeks ago and had the full week off the phones and were not sent home.

I have now been informed that i will be taken to a disciplinary for my absence and i will not be paid.

Surly they cant do this as i offered to work but just couldnt do that one task of being on the phones???

Can anyone help me here?????????

I'm afraid they can hun, i have a similar problem with my job, i'm on my second warning for having time off sick with the illness i have. Go and ask citizen's adivce beruo, as they might be able to give you a different ask to what they gave me, as your's is slightly different.

when i called in this morning to say my voice wasnt any better the first thing they offered was off the phone work - i told her that was strange since they had none yesterday - i explained what happened she called me back ten minutes later saying there was none. So im wondering are they offering it to some people and not others?

If you are sick you are sick. Get a line from your GP. They cannot argue with him/her. This is 2006 ffs. You are entitled to certain statutory rights including sick pay. Check with the C.A.B.:angry:

I checked with them, with my problem, and there's nothing i can do, they are perfectly with-in thir rights to sack me! Oh well it wuld be there loss, been there for 16 years and do 7 different job roles, so if they want to shoot themselves in the foot, then they can be my guest! lol

Next time my illness comes back my Dad say's he is going to take me in and leave me in the managers office and she can sort me out! Clear up my puke and listen to me in pain etc.... :rotfl: (I'm kinda hoping it doesn;'t come back again incase he actually does take me in!)

Get a note from the Doctors, take that to the disciplinary. Do you have a union rep? I would speak to them as well.

They can't sack you for losing your voice.

Here where I work in a call center too, if someone is really ill and loses there voice we offer them off the phone work immediately. We get them to work on other stuff like projects. If we are sent home sick, we do get mark as absent but if it is prolonged we have to have doctors letter and social welfare pay for the absence.

I dont' think they can sack you for been sick, they can for not doing your job but you have offered them an alternative. Personally if they treated me like that, i would go on the phones and if they get bad feedback from customers then it is there fault for not offering you alternative.

Can't believe you have been there 16 years and they are treating you like this. I know in a call center there is loads of other things to do and because of your long service it should be offered to you.

It's unfortunate that in many 'modern' places of work, rules & regulations on absence are tighter than ever.

Businesses simply want to minimise the number of days they lose each year due to people being 'on the sick', which can mean thousands of pounds worth of expenses.

I think that the majority of employers now operate a zero-tolerance policy on absence. So even if you are ill, you will still face disciplinary action.

We've got all the people who 'nick off' whenever they feel like it to thank!

need help again!!!

Found out today that i because of the warning i got with this absence i am not intitled to getting my bonus for 12 months (when i asked my boss he said 4 months) can they do this? I also found out that everyone in the team recieved a £1,300.00 pay rise today, i didnt when i asked about this i was told it was because of the written warning on my file i do not qualify for the rise. Can they do this?? And more to the point shouldnt they have explained this in my letter or meeting when i was given the warning???

Unfortunatly they can do this which sucks big time. My husband was given a warning a couple of years ago, when everyone received a pay rise that year he remained on the same wage as before. He questioned this and was informed that his wage would be reviewed in 6 months, subject to attendence etc. However it never was:rolleyes:

Secondly he did not receive a christmas bonus because of the action brought against him.

If you really want to contest it I would suggest contacting HR.

I am at present off sick due to a serious medical condition which will mean me being off for 6 weeks or more. I thought my boss would have went mental but surprisingly he was very good about it. I gave him the sick line and he told me to leave my bank details with the book-keeper and she would lodge my wages every week in the bank. I work for a small firm and this is the first time I have been off sick in 14 yrs. I really thought he would put me on to SSP:)

I would be WRITING to HR now. Don't call - they might not record it - put evey issue on paper. Then if you get no satisfaction call the CAB.


How can being sick result is a written warning!!!

My God - I would have been sacked years ago!

(Of sick now - today with a virus - only back from my hysterectomy 15th November - I was off for 3 months then!)

When you do write make sure you keep photocopies of everything you send them. Then when they say they've "lost" them you can send them another copy.

Check your contract to see if it says anything about warnings and bonuses. If it doesn't and they haven't written to you otherwise to inform you then I don't know if they can withdraw your bonus. (I'm not sure though so don't quote me on it.)

Did you get a verbal warning before the written one? I would have thought they would have given you a verbal warning before a written one.

Come on tell me they cant do that!!!!!!!!

how many times can you get punished for the one warning?? you didn't get bonus, you don't get SSP, is there anything else they can take of you?? i would check this out with a lawyer or someone who deals with work laws

How can they refuse you SSP?? You're entitled to it if you're sick, I really don't think they can refuse you that.
Like Siobhan says, go see a lawyer.

i was off for 8 days in total and handed in a sick note on the 3rd day

Only 8 days and you had a sick note!!! I know people here that was off for a month and had a sick note and they didn't even get a verbal warning

Aren't the first 7 days self signed anyway?! I really can't see how they can do this Lee - you need to check this out with a lawyer or someone :angry:

I think you definatly need to speak to a solicitor, or the CItizens Advice, its a lot of punishment for a warning that you really shouldnt have gotten in the first place. The sick note is the correc procedures and you did everything correctly. I know loads of people who take loads of time off and never bring in a sicknote.
