I know someone on here is studying law and I would like to ask a legal question

If you have an accident through speeding and someone dies as a result, are you just charged for speeding or manslaughter?

If the person survives, are you charged with ABH or again just speeding?

I would imagine you would be charged with Reckless Driving causing death or if the person didnt die then just plain Reckless Driving. It really depends on the circumstances,

I would think it would also depend on the speed you were doing too, as that could count for dangerous driving possibly. I think there can be many variants depending on the speed the person was travelling at, the road conditions, the type of road etc.

Not much help I know, but a little I hope.

Not much help I know, but a little I hope. As far as I know the offence of Dangerous Driving was replaced with Reckless Driving but asa you say it all depends on the speed having regard to the road conditions

It would be nice if it was easier for the road user to understand - looking through the direct gov website, there are so many different terms for which points for speeding terms are issued, and the number of points issued too. Manslaughter, careless, reckless, without due care, under the influence etc (last time I looked anyway). Slight nightmare.

Do you have a second occupation there Alan? Plus being in Ireland too helps as it tends to differ there slightly (doesn't it?!)

The one good thing I have is a brother in law who's a police officer in Wales, so its helped to know what speed the cameras are set to on the M4 (although I never go above .... mph)

no. just a discussion we were having at work.. I think they should be charged with ABH or manslaughter if they are way about the speed limit as they are aware of the dangers before they do that but common sense goes out the window.

Its classed as a driving offence. My Tuter reckons if you ever want to murder someone then do it in a car.

See that is what I mean.. surely killing someone while speeding or drinking should be classed as more than driving offence.. you are not in control and there is many many government warning about dangers of speeding and drinking

I always thought it was 'causing death by dangerous driving'. That's what Karen Betts on Bad Girls was charged with anyway.

if someone dies from someone else speeding then i think they should get done for murder as if there stupid enough to speed and not care if a life gets took then they should get life in prison
