Adam and Jess marrying

Ok, so from the recent press office release we know they are due to marry on new years eve.

But...since when did Jess divorce Sean? Aren't they still married, just seperated,
Might she commit bigamy?
Or have they been divorced?

If Sean refused to divorce her then she'd have to wait five years for their marriage to be annulled.

I think they are still married but it could be done in a short space of time if both parties agreed and didn't fight over custody of the children and what each is entitled to from the other. The house has already been sold so that wouldn't be an issue.
